Affiliate Policy - Terms & Conditions

These Terms and Conditions (the "Affiliate Agreement") govern the Affiliate Program that is made available by JohanClaeys.com. These Terms and Conditions represent the whole agreement and understanding between JohanClaeys.com and the individual or entity who participates in the Affiliate Program.

By submitting your application and by your use of the Affiliate Program, you agree to comply with all of the terms and conditions set out in this Affiliate Agreement.

The Basics in plain English

Anyone can join the johanclaeys.com affiliate program and you are welcome to use all my affiliate tools as well as any ethical means to promote my products. You earn commission through affiliate site links available in your dashboard.

All commissions are paid once monthly, after a 30-day delay (Net 30 basis) to ensure that any refunded purchases can be deducted from the commission. Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

Privacy Policy

Johanclaeys.com respects the privacy of all it's affiliates and partners and will not share or sell any of your information with 3rd party without your explicit consent nor your referrals.

Promotion

a. Once you have signed up as an affiliate, I will provide you with a unique referral link (“Link”) that links to JohanClaeys.com website to start the enrolment process. Whenever you tell a potential new subscriber about JohanClaeys.com and how I can help improve their email marketing and business automation through training, you or the potential new subscriber will just use that Link, and I will take care of the rest. You must use the Link, otherwise, we have no way of tracking or knowing where the new subscriber came from, and I will not be able to pay you your commissions. To qualify under the Affiliate Referral Program, any new subscriber must not have been a previous subscriber to any of my Services.
b. You and johanclaeys.com will cooperate in good faith to promote the Services. Each Link will permit recipients to navigate directly to a page on a JohanClaeys.com website designated via a special tagged link format.
c. By becoming an affiliate for JohanClaeys.com, you agree to receive relevant updates, news and tips via email that will help you increase your affiliate commission. So by adhering as an affiliate you also consent to be added to my newsletter list. You can unsubscribe my newsletter at any time, but I urge you to stay subscribed so you can hear about promotions, events and related news.

Affiliate and merchant rights

Let's get the unpleasant stuff out of the way

The Affiliate will conduct its business and activities in a manner that promotes a good, positive image and reputation for JohanClaeys.com and the Services. Without limiting the generality of the foregoing, Affiliate will not:

a. use any inappropriate form of promotional, marketing, or advertising activity with your Link or Affiliate Site, which includes use of any misleading hyperlinks and making any false, misleading, or disparaging representations or statements with regard to JohanClaeys and the Services;
b.You are not allowed to present any kind of cashback scheme, bonus initiative, coupon discount or claim that customers can get any sort of discount by purchasing through your affiliate link.
c. engage in any unfair or deceptive trade practice involving the Services;
d. participate in any promotion, advertising, marketing, or sale of any imitation of the Services;
e. include or provide for in any Affiliate Site any page, screen, or social media platform that contains content that: advocates discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age; promotes or engages in illegal activities, violates intellectual property rights of third parties, or contains or promotes deceptive information; and
f. impersonate JohanClaeys;
g. use any Marks to mislead potential new subscribers into believing you are endorsed or employed by JohanClaeys;
h. use the string “Johan Claeys” for any website domain name;
i. You are not allowed to use any form of spam to promote Johanclaeys products. Spam or send bulk-emails including Links;
j. use paid advertising, search, or social pages for promoting Links; You are not allowed to use pay per click advertising to bid on brand keywords. This includes Johanclaeys or any of Johans product names
k. JohanClaeys.com does not approve purchases of affiliates through their own affiliate links. Use its own Link to purchase any Services; except the Affiliate can use his own affiliate link and get cashback on JohanClaeys.com products
l. JohanClaeys.com does not approve make or authorize any proposal, representation, warranty, guarantee, or communication relating to the Services that is inconsistent with JohanClaeys’s standard terms and policies, or that has not been approved or otherwise authorized by JohanClaeys in writing.
m. claim that any of JohanClaeys products or promotional materials were authored by himself. He may not do anything to impersonate the johanclaeys.com brand or johanclaeys.com personnel.

Termination

The Affiliate may terminate the Affiliate's participation in the Affiliate Program with immediate effect by giving the other party written notice of termination.

JohanClaeys.com may terminate your Affiliate Account at any time, with or without notice, for conduct that is in breach of this Affiliate Agreement, for conduct that Website.com believes is harmful to its business, or for conduct where the use of the Affiliate Program is harmful to any other party.

Upon termination, the Affiliate will lose access to its Affiliate Dashboard and will forfeit all potential or unpaid Affiliate Fees.

Affiliate links

JohanClaeys.com will provide the Affiliate with specific Referral Links to link advertisements and other marketing content to JohanClaeys.com. JohanClaeys.com will track users who have visited these Referral Links using cookies which expire after 30 days. Only users who make a purchase while the cookie is active will be considered referrals of the Affiliate and recorded as such in the Affiliate Dashboard.

The Affiliate is not authorized to modify or alter the Referral Links or the cookies in any way. JohanClaeys.com is not responsible for any tracking or reporting errors that may result from any modifications to the Referral Link or the cookies.

You may use graphic and text links both on your website and within in your email messages. You may use the graphics and text provided by me in a dropbox folder, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined.

Liabiliity

JohanClaeys.com will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or my website.

Relationships of parties

JohanClaeys.com and the Affiliate are independent contractors. Nothing in this Affiliate Agreement will create any partnership, employment, representative, agency, or joint venture relationship between the parties. The Affiliate has no authority to act on JohanClaeys.com's behalf.

Limitation of liability

The Affiliate Program is provided on an "as is" and "as available" basis and the use of the Affiliate Program is at the Affiliate's own risk. JohanClaeys.com makes no representations or warranties, either expressed or implied, with respect to the Affiliate Program, or any service or information provided through the Affiliate Program.

JohanClaeys.com is not responsible for any damages, injury or economic loss arising from the use of the Affiliate Program. Should any part of the Affiliate Program cause damage or inconvenience to the Affiliate or anyone claiming through the Affiliate, the Affiliate assumes responsibility and the entire cost for them.

The Affiliate will indemnify and hold harmless JohanClaeys.com, from and against any losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to the Affiliate's or any third party's operations or use of the Affiliate Program.

Modification

JohanClaeys.com may, in its sole discretion, change or modify this Affiliate Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Affiliates upon posting of the modified Affiliate Agreement to this web address: http://www.johanclaeys.com. The Affiliate is responsible for reading this document from time to time to ensure that its use of the Affiliate Program remains in compliance with this Affiliate Agreement.

If any modification is unacceptable to the Affiliate, its sole recourse shall be to terminate this Affiliate Agreement. The Affiliate's continued participation in the Affiliate Program will constitute binding acceptance of such modifications.

Miscellaneous

The Affiliate warrants and represents that it is over the age of 19 and is qualified to enter into this Affiliate Agreement.

The Affiliate warrants and represents that its actions and its participation in the Affiliate Program is in compliance with all applicable laws, rules, regulations, and any requirements of governmental authority at all times. JohanClaeys.com reserves the right to terminate the Affiliate's participation in the Affiliate Program if Website.com determines, in its sole discretion, that the Affiliate's actions or its participation in the Affiliate Program are in violation of any laws, rules, regulations, or any requirements of governmental authority.

This Affiliate Agreement constitutes the entire understanding between JohanClaeys.com and the Affiliate. This Affiliate Agreement supersedes any other contracts or understandings between the parties hereto and neither party shall be bound by any statements or representations that are not embodied in this Agreement.

Notice of governing law

Any dispute arising in relation to this Affiliate Agreement shall be exclusively resolved in the Courts of Belgium.
